Introduction

In this chapter, we will learn how the public sector in Canada must comply with the rules when purchasing goods and services. These policies, regulations and agreements provide guidance for efficient and effective procurement in line with a public organization’s objectives and tasks. We will also discuss the principles and processes of public procurement, including planning, tendering, contract management, and evaluation. After reviewing this chapter, we will also acquire an understanding of the legal and regulatory environment governing public procurement.

Learning Objectives

Upon successful completion of this chapter, you will be able to:

  1. Explain the different procurement regulations in the public sector stipulated by Government Structures and Authority: Federal, Provincial/State and Regional.
  2. Provide an overview of Canadian law and explain the relationship between the rule of law and the Charter of Rights and Freedoms.
  3. Distinguish between various forms of law applied in Canada and the systems and mechanisms supporting the operations of law.
  4. Explain the principal-agent model.
  5. Understanding the purpose of business legislation and regulation in Canada in public procurement.
