Explanation

Section 6 of the Copyright Act states:

Except as otherwise expressly provided by this Act, the term for which copyright subsists is the life of the author, the remainder of the calendar year in which the author dies, and a period of 70 years following the end of that calendar year.

The work in question is out of term for its copyright in Canada based on the criteria above or by another provision in the Copyright Act.

Legal scholarship suggests that works created by artificial intelligence are not protected by copyright in Canada, however, there is uncertainty around this statement at present.
